Section 1. SMS and text messaging terms
All Terminal Services, LLC, d/b/a Aviro360 provides AI-powered yard visibility, gate automation, inventory and security technology for distribution centres, manufacturing plants, retailers and third-party logistics operators. When you opt in to receive SMS messages from us, you may receive appointment confirmations for the 30-Minute Yard Assessment, reminders, and follow-up communications related to your enquiry, and marketing communications about our yard visibility and gate automation technology, operational guidance and related insights.
1A. How to cancel SMS (STOP)
You can cancel the SMS service at any time. Just text “STOP” to the phone number from which you received our messages. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected] or [PHONE NUMBER].
1C. Carrier liability
Carriers are not liable for delayed or undelivered messages.
1D. Message frequency and rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages based on your consent selections. Marketing messages may vary in frequency; appointment confirmations and Yard Assessment reminders are sent as events occur. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

All advertised prices are in U.S. Dollars. We reserve the right to limit the sale of our services to any person, geographic region, or jurisdiction at our sole discretion.
Section 7. Refund policy
As our services are delivered electronically and professionally, they are considered rendered upon delivery. All Terminal Services, LLC, d/b/a Aviro360 does not offer refunds on digital services or subscription fees once delivered. If you are not satisfied with our services, your recourse is to cancel your subscription going forward. No partial or prorated refunds will be issued for the remaining portion of a billing cycle.

Section 8. Subscription terms and automatic payments
Subscription fees are due on a recurring basis as specified at the time of purchase. By subscribing, you authorise All Terminal Services, LLC, d/b/a Aviro360 to charge your payment method automatically on each billing date. Failure to use available services does not relieve you of your payment obligations. You may cancel your subscription at any time in accordance with Section 7.
Section 9. Your responsibilities
You represent and warrant that you operate a business in good standing and that there are no prior or pending government investigations or prosecutions against you or your business. You agree to use Aviro360’s services only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to laws governing advertising, marketing claims, email marketing (CAN-SPAM Act), and telemarketing (TCPA and FTC Telemarketing Sales Rule).
You are solely responsible for compliance with all laws applicable to your business. All Terminal Services, LLC, d/b/a Aviro360 does not provide legal, tax, accounting, or financial advice. You should consult qualified professionals for advice on those topics.
Section 10. Testimonials and reviews
All Terminal Services, LLC, d/b/a Aviro360 welcomes feedback from clients and users. We may use testimonials and reviews in whole or in part, together with the name and location of the person submitting them, for any purpose related to our services and marketing, as we determine in our sole discretion. Testimonials represent the unique experience of the individual and do not guarantee that you will achieve the same results.

Section 13. Dispute resolution: mandatory binding arbitration

EXCEPT WHERE PROHIBITED BY LAW, YOU AGREE THAT ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR AVIRO360 SERVICES MUST BE RESOLVED THROUGH FINAL AND BINDING CONFIDENTIAL ARBITRATION. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU MAY ONLY BRING CLAIMS IN AN INDIVIDUAL CAPACITY.
Section 14. Indemnification
You agree to defend, indemnify, and hold harmless All Terminal Services, LLC, d/b/a Aviro360, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, actions, demands, liabilities, and settlements, including reasonable legal and accounting fees, arising from or related to your violation of these Terms or any activity related to your account.

Section 16. Termination
All Terminal Services, LLC, d/b/a Aviro360 may terminate your access to all or any part of our website or services at any time, with or without cause, effective immediately. All provisions of this Agreement that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If a revision is material, we will provide at least 30 days’ notice prior to new terms taking effect. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
